SCOPE OF APPLICATION

These terms and conditions apply to contracts for the rental of hotel rooms for accommodation purposes, as well as all other services and deliveries provided by the hotel for the customer in this context (Hotel Accommodation Contract). The term “Hotel Accommodation Contract” includes and replaces the following terms: accommodation, lodging, hotel, and hotel room contract.

The sub-letting or re-letting of the rooms provided, as well as their use for purposes other than accommodation, require the prior consent of the hotel in writing, whereby section 540 paragraph 1 sentence 2 of the German Civil Code (BGB) is waived insofar as the customer is not a consumer.

The customer’s general terms and conditions shall only apply if this has been expressly agreed in writing beforehand.

II. CONCLUSION OF CONTRACT, PARTNERS, STATUTE OF LIMITATIONS

The contract is concluded upon the hotel’s acceptance of the customer’s application. The hotel is free to confirm the room booking in writing.

The contracting parties are the hotel and the customer. If a third party has ordered on behalf of the customer, they shall be liable to the hotel together with the customer as joint and several debtors for all obligations arising from the hotel accommodation contract, provided the hotel has received a corresponding declaration from the third party.

In principle, all claims against the hotel shall lapse one year after the statutory commencement of the limitation period. Claims for damages shall lapse after five years regardless of knowledge, unless they are based on injury to life, limb, health, or liberty. These claims for damages shall lapse after ten years regardless of knowledge. The reductions in the limitation period do not apply to claims based on an intentional or grossly negligent breach of duty by the hotel.

III. SERVICES, PRICES, PAYMENT, SET-OFF

The hotel is obliged to keep the rooms booked by the customer available and to provide the agreed services.

The customer is obliged to pay the agreed or applicable prices of the hotel for the provision of the room and the other services used by them. This also applies to services and expenses incurred by the hotel towards third parties at the customer’s request. The agreed prices include the respective statutory value-added tax.

The hotel may make its consent to a subsequent reduction in the number of booked rooms, the hotel’s services, or the customer’s length of stay requested by the customer dependent on the price for the rooms and/or for the hotel’s other services being increased.

Invoices from the hotel without a due date are payable within 10 days of receipt of the invoice without deduction. The hotel may demand immediate payment of due claims from the customer at any time. In the event of default in payment, the hotel is entitled to demand the applicable statutory default interest at the current rate of 8% or, in the case of legal transactions involving a consumer, at a rate of 5% above the base interest rate. The hotel reserves the right to prove higher damages.

The hotel is entitled to demand a reasonable advance payment or security deposit from the customer upon conclusion of the contract in the form of a credit card guarantee, a down payment, or similar. The amount of the advance payment and the payment dates may be agreed in writing in the contract. In the case of advance payments or security deposits for package tours, the statutory provisions remain unaffected.

In justified cases, e.g. payment arrears by the customer or extension of the scope of the contract, the hotel is entitled to demand an advance payment or security deposit within the meaning of number 5 above, or an increase in the advance payment or security deposit agreed in the contract up to the full agreed remuneration, even after the conclusion of the contract until the start of the stay.

Furthermore, the hotel is entitled to demand a reasonable advance payment or security deposit within the meaning of number 5 above from the customer at the beginning of and during the stay for existing and future claims arising from the contract, insofar as such has not already been provided in accordance with numbers 5 and/or 6 above.

The customer may only set off or offset an undisputed or legally binding claim against a claim of the hotel.

IV. CANCELLATION BY THE CUSTOMER (WITHDRAWAL, CANCELLATION) / NON-USE OF HOTEL SERVICES (NO SHOW)

A cancellation by the customer of the contract concluded with the hotel requires the hotel’s consent in writing. If this is not provided, the agreed price under the contract must be paid even if the customer does not make use of the contractual services.

If a date for cost-free cancellation of the contract has been agreed in writing between the hotel and the customer, the customer may cancel the contract until then without triggering payment or damage claims by the hotel. The customer’s right of cancellation expires if they do not exercise their right of cancellation towards the hotel in writing by the agreed date.

In the case of rooms not used by the customer, the hotel must credit the income from other rentals of these rooms as well as the saved expenses. If the rooms are not rented to others, the hotel may demand the contractually agreed remuneration and apply a flat-rate deduction for the hotel’s saved expenses. In this case, the customer is obliged to pay at least 90% of the contractually agreed price for overnight stays with or without breakfast, 70% for half-board arrangements, and 60% for full-board arrangements. The customer is free to prove that the aforementioned claim has not arisen or has not arisen in the amount requested.

V. CANCELLATION BY THE HOTEL

If it has been agreed in writing that the customer can cancel the contract free of charge within a certain period, the hotel is for its part entitled to cancel the contract during this period if there are enquiries from other customers for the contractually booked rooms and the customer does not waive their right of cancellation upon enquiry by the hotel.

If an agreed advance payment or security deposit, or one requested above in accordance with Section III numbers 5 and/or 6, is not made even after a reasonable grace period set by the hotel has expired, the hotel is also entitled to cancel the contract.

Furthermore, the hotel is entitled to cancel the contract extraordinarily for an objectively justified reason, for example if

Force majeure or other circumstances for which the hotel is not responsible make the fulfilment of the contract impossible;

rooms or spaces are booked culpably under misleading or false statements of facts essential to the contract, e.g. regarding the identity of the customer or the purpose of their stay;

the hotel has justified reason to believe that the use of the hotel service may jeopardise the smooth operation of the business, the security, or the reputation of the hotel in public, without this being attributable to the hotel’s sphere of control or organisation;

the purpose or occasion of the stay is unlawful;

there is a violation of the aforementioned Section I number 2.

In the event of a justified cancellation by the hotel, the customer shall have no claim for damages.

VI. ROOM PROVISION, HANDOVER AND RETURN

The customer does not acquire a claim to the provision of specific rooms, unless this has been expressly agreed in writing.

Booked rooms are available to the customer from 15:00 on the agreed day of arrival. The customer has no claim to earlier provision.

On the agreed day of departure, the rooms must be vacated and made available to the hotel by 11:00 at the latest. Thereafter, due to the late vacating of the room, the hotel may charge 50% of the full lodging price (list price) for its use exceeding the contract until 18:00, and 100% from 18:00. Contractual claims of the customer are not established by this. The customer is free to prove that the hotel has incurred no or a significantly lower claim for usage fees.

VII. LIABILITY OF THE HOTEL

The hotel is liable for its obligations under the contract. Claims of the customer for damages are excluded. Excepted from this are damages resulting from injury to life, limb, or health if the hotel is responsible for the breach of duty, other damages based on an intentional or grossly negligent breach of duty by the hotel, and damages based on an intentional or negligent breach of typical contractual duties of the hotel. A breach of duty by the hotel is equivalent to that of a legal representative or vicarious agent. Should disruptions or defects in the hotel’s services occur, the hotel will endeavour to provide a remedy upon knowledge or immediate complaint by the customer. The customer is obliged to contribute what is reasonable to them to remedy the disruption and keep any possible damage to a minimum.

The hotel is liable to the customer for items brought in according to the statutory provisions. According to these, liability is limited to one hundred times the room price, but at most €3,500, and deviating for money, securities, and valuables at most up to €800. Money, securities, and valuables can be stored in the hotel or room safe up to a maximum value of € (insert hotel’s insurance sum). The hotel recommends making use of this option.

Insofar as a parking space in the hotel garage or in a hotel car park is made available to the customer, even for a fee, this does not constitute a safekeeping agreement. In the event of loss of or damage to motor vehicles parked or manoeuvred on the hotel property and their contents, the hotel is not liable, except in cases of intent or gross negligence. For the exclusion of the customer’s claims for damages, the regulation of the preceding number 1, sentences 2 to 4 applies accordingly.

Wake-up calls are carried out by the hotel with the greatest care.
Messages, mail, and shipments of goods for guests are handled with care. The hotel undertakes the delivery, storage, and – upon request – forwarding of the same for a fee. For the exclusion of claims for damages by the customer, the regulation of the preceding number 1, sentences 2 to 4 applies accordingly.

VIII. FINAL PROVISIONS

Amendments and supplements to the contract, the acceptance of the application, or these General Terms and Conditions should be made in writing. Unilateral amendments or supplements by the customer are invalid.

The place of performance and payment is the location of the hotel.

The exclusive place of jurisdiction – also for cheque and bill of exchange disputes – in commercial transactions is the registered office of the hotel. Insofar as a contracting party fulfils the requirement of section 38 paragraph 2 of the German Code of Civil Procedure (ZPO) and has no general place of jurisdiction in Germany, the registered office of the hotel shall be the place of jurisdiction.

German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and conflict of laws is excluded.

Should individual provisions of these General Terms and Conditions be or become invalid or void, the validity of the remaining provisions shall not be affected thereby. In all other respects, the statutory provisions apply.

Terms and Conditions I.
